Do I have to pay Illinois state tax if I am a Texas resident?
I work from home in Texas for an Illinois-based company. I am employed and my company is withholding Illinois tax on my W2. I do all my work in Texas and never physically work within illinois. Texas does not have any state income tax.
I can’t find any definitive information or publications that seems to be helpful.
Thank you.
Since you do not live or work in IL, you do not pay IL tax. Your employer should NOT be withholding IL State income tax!
Where your employer is located is irrelevant. What matters is where YOU live and where YOU work.

Your income is not subject to IL state tax. If the employer is not able to refund you the state taxes, then you will need to file state tax return to get the refund.. Attach statement from your employer that you were never present in IL to work.
